Terms & Conditions

These Terms & Conditions govern your participation in Behaviour: Clarity for Change, a structured three-phase programme delivered by Behaviour for Learning, operated by Roisin Mcilduff. By enrolling and paying for this programme, you confirm that you have read, understood, and agree to everything set out below.

Behaviour for Learning is an Australian sole trader. All services are provided in accordance with applicable Australian law, including the Australian Consumer Law (ACL) and the Privacy Act 1988 (Cth).

1. About the Programme

Behaviour: Clarity for Change is a structured, three-phase programme designed to help families understand and respond to their child’s behaviour. The programme is delivered online via Zoom and includes personalised consultations, a tailored written behaviour support plan, and follow-up support.

Programme structure:

·   Phase 1 – The Clarity Intensive: 2-hour consultation, intake review, and tailored behaviour profile.

·   Phase 2 – Strategy & Implementation: Four 1-hour consultations delivered over 8 weeks, written behaviour support plan, and tailored tools and resources.

·   Phase 3 – Review & Consolidation: One 60-minute review session and 30 days of email follow-up support.

Nature of services:

All services are educational and capacity-building in nature. They do not constitute therapeutic, clinical, diagnostic, or crisis support, and are not a substitute for advice from your child’s medical, psychological, or allied health team. You are encouraged to continue working alongside existing professionals where relevant.

2. Programme Fee & Payment

·   The total programme fee is $5,000 AUD.

·   Payment may be made in full at enrolment, or via two instalments of $2,500 AUD each.

·   Instalment 1 ($2,500): Due at enrolment, prior to the Clarity Intensive (Phase 1).

·   Instalment 2 ($2,500): Due 30 days after the Clarity Intensive.

·   The programme does not commence until the first instalment (or full payment) has been received.

·   A receipt will be issued for each payment.

3. Cancellations, Refunds & Rescheduling

Programme cancellation by the client

Because this is a structured programme with resources, preparation, and consultation time allocated at each phase, the following refund schedule applies:

·   Before Phase 1 commences: Full refund of any amount paid, less a $250 administration fee.

·   After Phase 1 but before Phase 2 commences: 50% of the total programme fee ($2,500) is retained. If you have paid the first instalment only, no further payment is due. If you have paid in full, a refund of $2,250 will be issued.

·   After Phase 2 commences: No refund is available. The programme is considered substantially delivered.

Your rights under the Australian Consumer Law (ACL) are not excluded by this policy. If a service is not delivered as described or does not meet consumer guarantees, you may be entitled to a remedy.

Individual session cancellations & rescheduling

·   A minimum of 24 hours’ notice is required to reschedule any session.

·   Sessions cancelled with less than 24 hours’ notice, or not attended (no-show), will be forfeited without the opportunity to reschedule, unless exceptional circumstances apply.

·   Exceptional circumstances (e.g. serious illness, family emergency) may be considered at Roisin’s discretion upon written request.

·   Rescheduling is subject to availability.

Cancellation by Behaviour for Learning

In the unlikely event that Behaviour for Learning is unable to deliver any part of the programme, every reasonable effort will be made to reschedule at the earliest opportunity. If rescheduling is not possible, a pro-rata refund for undelivered sessions will be issued.

Programme suspension

If a session becomes unsafe or inappropriate — including abusive, threatening, or disrespectful behaviour directed at Roisin — Behaviour for Learning reserves the right to end the session immediately and, at its discretion, suspend or terminate the programme without refund for sessions already delivered.

4. Technical Issues & Online Delivery

Sessions are delivered via Zoom. Both parties are responsible for ensuring they have a stable internet connection, a compatible device, and a suitable environment for the session.

Technical difficulties during sessions

·   If a session is interrupted due to a technical issue (e.g. internet outage, platform failure, device fault) on the part of either party, every effort will be made to reconnect within 10 minutes.

·   If reconnection is not possible, the session will be rescheduled at no additional cost, subject to availability.

·   If a significant portion of the session has already been delivered (more than half), the session will be considered substantially complete and may not be rescheduled in full.

·   Repeated technical disruptions on the client’s side that prevent programme delivery do not entitle the client to a refund for sessions already attempted.

Platform and software

·   Zoom is provided as a convenience. Behaviour for Learning is not responsible for Zoom’s availability, reliability, performance, or any changes to its terms of service.

·   If Zoom becomes unavailable, an alternative video platform may be used by mutual agreement.

·   It is the client’s responsibility to ensure they can access and operate the agreed platform.

Force majeure

Behaviour for Learning will not be in breach of these Terms, and no liability will arise, where delivery is prevented or delayed by circumstances beyond reasonable control. This includes but is not limited to: natural disaster, illness or family emergency, power outages, internet infrastructure failures, or platform outages. In such cases, every reasonable effort will be made to reschedule at the earliest opportunity.

5. Session Recordings

Sessions are conducted via Zoom and may be recorded. Recordings are made for the following purposes only:

·   Reflective practice and quality assurance

·   Internal professional development

·   Preparation of your tailored written support materials

Recordings are kept strictly confidential and will never be shared externally, published, or used in any marketing or promotional material without your explicit written consent.

Footage of Roisin Mcilduff may be used for professional education or marketing purposes. Your information, voice, image, and your child’s details will never be used in any public or promotional context without your prior written consent.

Recordings are stored securely and retained only for as long as operationally necessary. You may request information about how your recording is stored at any time.

6. Privacy & Confidentiality

Collection and use of personal information

Behaviour for Learning collects personal information (including information about you and your child) for the purpose of delivering the programme and providing follow-up support. This is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

Information collected may include:

·   Contact details (name, email, phone)

·   Your child’s name, age, school, and relevant background information

·   Behaviour descriptions, goals, and session notes

·   Payment information (processed securely through our payment provider)

How your information is used

Your information is used only to deliver the programme, communicate with you about your sessions, maintain internal records, and meet any legal obligations. It will not be used for marketing without your consent.

Third parties

Your personal information will not be shared with any third party without your consent, except where required by law or where there is a risk of harm. Any liaison with other professionals (e.g. your child’s school or treating team) will only occur with your written consent.

Confidentiality limits

Confidentiality will be maintained except where disclosure is required by law or where there are reasonable grounds to believe a child or person is at risk of harm.

Data security & access

Your information is stored securely. You have the right to request access to your personal information and to request corrections where information is inaccurate. Requests can be made directly to Roisin Mcilduff in writing.

7. Intellectual Property

All resources, tools, strategies, templates, workbooks, written plans, and materials created and provided by Behaviour for Learning are protected by copyright and remain the intellectual property of Behaviour for Learning.

Upon enrolment, you are granted a personal, non-transferable licence to use these materials for your own family’s use only. You may not:

·   Share, copy, reproduce, distribute, or forward materials to others

·   Upload materials to any shared platform, school system, or online service

·   Use materials for professional development, training, or commercial purposes without prior written permission

·   Adapt or repurpose materials without written consent

8. Liability & Disclaimer

Behaviour for Learning provides information, strategies, and support based on professional experience and evidence-informed practice.

You acknowledge and agree that:

·   You are responsible for how strategies and recommendations are implemented within your family and home.

·   Behaviour for Learning accepts no liability for any outcomes, incidents, injuries, or consequences — direct or indirect — arising from the application or misapplication of information or strategies provided during the programme.

·   Results are not guaranteed. Behaviour change depends on many factors, including consistency of implementation, the individual child, and the involvement of other professionals.

·   You are encouraged to seek advice from your child’s medical, psychological, or allied health professionals and not to rely solely on this programme.

9. Variations to These Terms

Behaviour for Learning reserves the right to update these Terms & Conditions from time to time. Where changes are material, clients currently enrolled in the programme will be notified in writing (by email) with reasonable notice. Continued participation in the programme following notification of changes constitutes acceptance of the updated terms.

The version of the Terms & Conditions in effect at the time of your enrolment governs your programme, unless you are notified of and agree to updated terms.

10. Governing Law

These Terms & Conditions are governed by the laws of South Australia, Australia. Any disputes arising from these Terms will be subject to the jurisdiction of the courts of South Australia, without excluding your rights under the Australian Consumer Law.

11. Feedback, Disputes & Complaints

Honest feedback is genuinely welcomed — it is how this programme continues to improve and how families are best served. If something hasn’t felt right, or you have a concern at any point, please say so. Early, direct communication will nearly always lead to a better outcome than silence.

Informal feedback

Feedback can be shared at any time during or after the programme, by email or during a session. There is no wrong time to raise a concern.

Dispute resolution

If a concern arises that is not resolved through informal conversation, both parties agree to make a genuine effort to resolve the matter directly and in good faith before escalating to a formal complaint or external body.

Formal complaints

·   Formal complaints should be submitted in writing by email.

·   Complaints will be acknowledged within 3 business days.

·   A full written response will be provided within 7 business days.

·   If the matter cannot be resolved directly, it may be referred to Consumer Affairs South Australia or an appropriate external dispute resolution process.

12. Agreement

By paying your enrolment fee (in full or by first instalment) and submitting your intake form, you confirm that you:

·   Have read and understood these Terms & Conditions in full

·   Agree to the cancellation and refund terms as outlined in Section 3

·   Understand the educational (non-clinical) nature of the programme

·   Consent to session recording as described in Section 5

·   Agree to the intellectual property conditions in Section 7

·   Understand your privacy rights and how your information will be managed
